DREAM POOL SWEEPSTAKES

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN
The Dream Pool Sweepstakes (“Sweepstakes”) is sponsored and administered by R & P Pools, Inc. dba Leisure Living and Poolsupplies.com, 574 Main Street, Tonawanda, New York 14150 (hereinafter “the Company”). The Sweepstakes is governed by these Official Rules.
ENTRY PERIOD:
The Entry Period for the Sweepstakes begins on June 28, 2023 at 12:01 a.m. EST and ends on July 7, 2023 at 11:59 p.m. EST.

ELIGIBILITY:
No purchase or payment of any kind is necessary to enter or win the Sweepstakes. A purchase or payment of any kind will not increase your chances of winning. Winning and receiving a Prize is conditioned upon fulfilling all requirements set forth in these Official Rules. You agree to be fully and unconditionally bound by these Official Rules and the decisions of the Company whose decisions shall be final and binding. The Sweepstakes is subject to applicable Federal, State and local laws and regulations and is void where prohibited or restricted by law. The Sweepstakes is limited to residents of the 48 contiguous United States and the District of Columbia who are at least 18 years of age at the time of submitting an entry. Residents of Alaska and Hawaii are not eligible to participate in the Sweepstakes. Directors, officers, employees, agents and representatives of the Company , as well as their immediate family and household members, are not eligible to enter.

The names of the Winners will be announced on Facebook® and Instagram®. By participating in the Sweepstakes you agree and consent to the Company disclosing your name on Facebook® and Instagram® if you are a Winner.

FACEBOOK® AND INSTAGRAM® DISCLAIMER:
As a condition of participating in the Sweepstakes you agree and acknowledge that Meta, Facebook®, Instagram®, and their associated entities are not sponsors or administrators of the Sweepstakes, nor do they endorse or are they otherwise associated with the Sweepstakes. As a further condition of participating in the Sweepstakes you agree to release Meta, Facebook®, Instagram® and their related entities from any and all liability arising out of or relating to your participation in the Sweepstakes.

HOW TO ENTER:
During the Entry Period, you may enter by the following methods:

d. Entry by Mail:
You may enter by completing and mailing the Official Sweepstakes Mail Entry Form which is accessed by clicking on this link: HERE. The Sweepstakes Mail Entry Form must be postmarked not later than July 7, 2023 and must be received by the Company not later than July 10, 2023. You may submit multiple Mail Entry Forms provided each entry form is mailed separately and is postmarked and received by the above dates. A maximum of two Mail Entry Forms will be accepted per person.

PRIZES:
Subject to verification of eligibility and compliance with these Official Rules, three entrants will be selected to win one of the following Prizes, which have a total value of $4,550.00:

a. GRAND PRIZE*: One Meadows Pool Package of any in-stock size, valued at up to $4,200. Click on below links for a description of the Meadows pools to choose from:

b. SECOND PRIZE: $250 Gift Certificate to Poolsupplies.com

c. THIRD PRIZE: $100 Gift Certificate to Poolsupplies.com

*GRAND PRIZE IMPORTANT NOTICE: The Winner is solely responsible for measuring and selecting a proper size pool for the location where it will be installed. The Pool Package includes a pool kit, liner, skimmer, filter, ladder, automatic cleaner and delivery to a location within the 48 contiguous states and the District of Columbia. The Company retains the right to substitute a Pool Package of equal or greater value if the Pool Package selected by the winner is out of stock at the time the Grand Prize winner is selected. The Pool Package includes liftgate delivery free of charge to the winner’s location. The Pool Package will be unloaded to the curbside of the delivery address. The Pool Package Prize does not include moving or the cost of moving the Pool Package from curbside to your garage, yard or other location. The Pool Package Prize also does not include the installation or the cost of installation, nor does it cover the cost of water, permits or fencing that may be required by law.

ALL OTHER COSTS AND EXPENSES RELATED TO ANY PRIZE NOT SPECIFIED HEREIN AND OTHER COSTS AND EXPENSES INCURRED BY ACCEPTING A PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.

ALL FEDERAL, STATE, AND LOCAL TAXES ON THE VALUE OF THE PRIZES ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNERS. THE WINNER OF THE POOL PACKAGE PRIZE SHALL BE REQUIRED TO COMPLETE AN IRS FORM W-9 AS A CONDITION OF BEING AWARDED SUCH PRIZE FOLLOWING WHICH THE COMPANY SHALL REPORT THE VALUE OF THE POOL PACKAGE PRIZE ON IRS FORM 1099-MISC.

PRIZE RESTRICTIONS:
Limit one (1) Prize per person or household. A Prize will be awarded only if the Potential Winner fully complies with these Official Rules. The Company shall have no responsibility or obligation to the Winner or a Potential Winner who is unable to, or does not for any reason, accept or utilize the Prize. No transfer, substitution, replacement or cash equivalent for a Prize will be provided except with respect to substitution of the Grand Prize if the selected Pool Package is not in stock, as noted above.

Prizes must be claimed in and shipped to an address within the 48 contiguous states (excluding Alaska and Hawaii) or the District of Columbia.
RANDOM PRIZE DRAWING; ODDS OF WINNING:

Three business days after the expiration of the mail in period on July 10th, there will be a random drawing from all eligible entries to select the 3 Potential Winners of the Prize.
Odds of winning a Prize depends on the number of eligible entries received during the Entry Period.

POTENTIAL WINNER NOTIFICATION AND REQUIRED VERIFICATION:

The Potential Winners are subject to verification of eligibility and compliance with all terms and conditions of these Official Rules. Within 3 days of the drawing, the Potential Winners will be notified via direct message on Instagram/Facebook, or in the case of mail-in and email entries via provided email addresses. If a Potential Winner fails to respond within 2 business days of the notification provided by the Company, the Potential Winner may be disqualified in the Company’s sole discretion.

A Potential Winner shall be required to verify his/her age by providing a copy of his/her valid driver’s license or other applicable government issued identification within 3 business days from the date when the notification direct message or email notification was sent. In the case of the Grand Prize Winner, the Potential Winner shall additionally be required to furnish a W-9 within 3 business days from the date when the notification message or email notification was sent. If a Potential Winner fails to respond or fails to provide the required information within the applicable time period the Prize shall be forfeited, unless the time period is extended in writing by the Company in its sole discretion.

In the event a Potential Winner is disqualified for any reason, or if a Prize is unclaimed, the Prize will be forfeited and will be awarded to an alternate Potential Winner by random drawing from among all remaining eligible entries. The eligibility of the alternate Potential Winner(s) shall be subject to the same requirements, as above.

MISCELLANEOUS:

The Company reserves the right to disqualify any person, including entrants and Potential Winners, who it determines has acted in violation of these Official Rules or in a manner which affects the fairness of the Sweepstakes or who engages in conduct which threatens or harasses any other person, including conduct directed toward the employees, agents and representatives of the Company.

By participating in the Sweepstakes entrants agree to be bound by these Official Rules. By participating in the Sweepstakes entrants release, indemnify and hold harmless the Company and its directors, officers, employees, agents and representatives, from and against any and all claims and causes of action relating to or arising out of participation in the Sweepstakes. Entrants agree that the decisions of the Company related to the Sweepstakes, including but not limited to the interpretation of these Official Rules and all drawings shall be final and binding in all respects. In the event of a dispute arising out of or related to the Sweepstakes that cannot be resolved between the parties, it is agreed that such dispute shall be resolved by arbitration under the Commercial Arbitration Rules of the American Arbitration Association. The Arbitrator’s decision shall be final and binding. The venue of any such Arbitration shall be in Erie County, New York. All issues, including the rights and obligations of the parties, and those related to the interpretation and enforceability of these Official Rules, shall be governed by the laws of the State of New York.

FREIGHT POLICY:

General Freight Shipping Information
Delivery times vary for items shipping by freight, you'll be notified by the freight carrier 1-2 days prior to delivery. An authorized signer (18 or older) must be present at time of delivery, and will be responsible for removing your item(s) from the freight truck.
Liftgate service can help get your item down from the truck, and is available for an additional charge (please call before or immediately after ordering if you'd like to add liftgate service to your freight order).
Refusal of delivery for any reason other than damaged merchandise is subject to shipping and restocking fees.

What should I do if my shipment is damaged?

Please compare your delivered items with the delivery bill, noting any differences in quantities or damages on the delivery bill BEFORE you sign. This will be required for filing a claim with the delivery company. Signing the delivery bill without noting all damaged and/or missing items implies that the shipment was delivered as expected, and neither poolsupplies.com or the shipping company can be held responsible for any lost or damaged items.
If there is a large amount of damage (large holes in boxes, contents spilling out, missing more than 10% of the boxes, etc.) please refuse delivery and contact us at 1-800-356-3025.

OFFICIAL RULES; NAMES OF WINNERS:

For a Winners’ List or a copy of these Official Rules, send a self-addressed, stamped envelope to R & P Pools, Inc., 574 Main St., Tonawanda, New York 14150. Indicate whether you are requesting a Winners’ List, Official Rules or both. All such requests must be post-marked and received by the Company no later than November 1, 2023.

USE OF PERSONAL INFORMATION:

All personal information collected by the Company through the Sweepstakes is subject to the Company’s Privacy Policy which can be accessed by clicking on this link: https://www.poolsupplies.com/page/privacy-policy. By participating in the Sweepstakes, you agree to the Company’s use of your personal information in accordance with the Company’s Privacy Policy, subject to your right to opt out in accordance with the Company’s Privacy Policy.
